1. About DayOf

DayOf (“DayOf,” “we,” “us,” or “our”) operates a managed marketplace for client entertainment around conferences and other professional events. Customers tell us about the event they are attending; our planners curate a catalog of vetted experiences, and we book and coordinate those experiences on the customer’s behalf with third-party operators.

These Terms of Use (“Terms”) govern your access to and use of dayof.travel, the reach-out form, the experiences catalog, and any related services we offer (collectively, the “Service”). By using the Service you agree to these Terms.

2. Who can use the Service

The Service is built for business customers entertaining clients around conferences. You must be at least 18, authorized to enter into agreements on behalf of any organization you are buying for, and able to provide accurate information. We may decline service for any reason permitted by law.

3. Reach-out and quotes

Submitting a reach-out form does not create a booking. It opens a conversation with our planners, who will reply with availability, pricing, and a written quote. A booking is only created when we confirm it with you in writing and you authorize payment.

4. Bookings and our role

DayOf curates and books experiences with vetted third-party operators — restaurants, venues, charter operators, and the like. We act as your buying agent for those bookings. The operator is the party providing the underlying experience; certain risks (such as last-minute closures, weather, or operator no-shows) sit with the operator. Where an operator fails to deliver, we will work with you in good faith to resubstitute, reschedule, or refund consistent with the booking terms we sent you in writing.

5. Pricing, payment, and cancellation

Pricing is quoted up front before you commit. Once you confirm a booking, the terms in the written confirmation control — including payment schedule, deposits, change windows, and cancellation fees. Operator-imposed fees (for example, a non-refundable deposit on a private venue) will be reflected in the written confirmation.

6. Your responsibilities

You agree to provide accurate information about your event, your group, and any access or dietary requirements. You are responsible for your group’s conduct at the booked experience and for any incidental costs you incur on site (additional bar tabs, damage, etc.) that fall outside the agreed scope.

7. Intellectual property

The Service, its design, copy, and curated catalog are owned by DayOf or its licensors. You may not copy, scrape, or redistribute the catalog or its content without our written consent.

8. Disclaimers and limitation of liability

The Service is provided “as is.” To the fullest extent permitted by law, DayOf is not liable for indirect, incidental, special, consequential, or punitive damages, and our total aggregate liability for any booking will not exceed the amount you paid DayOf for that booking.

9. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

10. Changes

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date. Continued use of the Service after an update means you accept the revised Terms.
